Title XII of the National Security Act of 1947, as added by section 701 and amended by sections 701 and 702 of this Act, is further amended by inserting after section 1203 the following new section: The head of each element of the intelligence community shall ensure that no personnel action (as defined in section 1104(a)) by such element is taken with a motivating factor of any of the following: A desire to reverse the impacts of societal discrimination based on race, color, religion, sex, sexual orientation, transgender status, or national origin.
A desire to provide role models to or aid in recruitment of individuals of the same race, color, religion, sex, sexual orientation, transgender status, or national origin. A belief or assumption that certain viewpoints or experiences can be ascribed to a person based on race, color, religion, sex, sexual orientation, transgender status, or national origin. Nothing in this section shall be construed to prohibit the head of an element of the intelligence community from taking into consideration linguistic ability, linguistic background, race, color, religion, sex, sexual orientation, transgender status, or national origin in those certain instances where such factor is a bona fide occupational qualification reasonably necessary for carrying out the job function, including maintenance of cover. .
