The Secretary of the Treasury shall establish an advisory committee to be composed of not fewer than 15 members, including representatives of industry, academia, trade organizations, environmental protection organizations, labor organizations, and international partners, as appropriate, who are qualified to provide advice on matters relevant to increasing domestic capacity of critical materials manufacturing. The Secretary, in carrying out paragraph (1), shall ensure that at least 2 members of the advisory committee established under such paragraph are representatives of— an environmental protection organization, and a labor organization.
Section 14 of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the advisory committee established under this subsection. In carrying out the development of guidance necessary to the implementation of subsection (a), the Secretary of the Treasury shall consult the following: The advisory committee established under subsection (a)(1). The Secretary of Agriculture. The Secretary of Commerce. The Secretary of Defense. The Secretary of Energy. The Secretary of Health and Human Services.
The Secretary of Homeland Security. The Secretary of the Interior. The United States Trade Representative. The Director of the White House Office of Science and Technology Policy. Such other head of a Federal agency as the Secretary determines appropriate.
