Chapter 361 of title 10, United States Code, is amended by adding at the end the following new section: Each contract or other agreement for the acquisition of any good or service entered into by the Department of Defense shall include for each external document referred to in such contract or other agreement a notation that— provides the version of such external document that is applicable to such contract or other agreement; and indicates whether any changes have been made to such external document after the issuance of the solicitation pursuant to which such contract or other agreement was entered into. If a contract or other agreement described in subsection
(a)does not include the notation required under such subsection for an external document referred to in such contract or other agreement, the version of the external document that shall apply with respect to such contract or other agreement is the version in effect at the time of the issuance of the solicitation pursuant to which such contract or other agreement was entered into. In this section, the term external document , with respect to a contract or other agreement, means a document to which such contract or other agreement refers that— is external to such contract or other agreement; and either— contains or affects any material term of such contract or other agreement; or otherwise modifies the performance required under such contract or other agreement. . The amendment made by subsection
(a)shall apply only with respect to contracts and other agreements entered into after the date of the enactment of this Act.
