Sec. 230. Limitation on availability of funds pending compliance with requirements relating to the Joint Energetics Transition Office

Of the funds authorized to be appropriated by this Act or otherwise made available for fiscal year 2026 for the Department of Defense and available for the Office of the Under Secretary of Defense for Acquisition and Sustainment for travel expenses, not more than 75 percent may be obligated or expended until the date on which the Secretary of Defense— establishes a Joint Energetics Transition Office as required under section 148 of title 10, United States Code; and submits to the congressional defense committees the reports required under subsections
(b)and
(c)of section 241 of the National Defense Authorization Act for Fiscal Year 2024 ( Public Law 118–31 ; 136 Stat. 208). The Secretary of Defense may waive the prohibition under subsection
(a)if the Secretary— determines that extenuating circumstances justify such a waiver; and provides to the congressional defense committees a briefing on the reasons for such determination.
