Sec. 1109. Exemption from civilian hiring freeze for delayed DOD appointments due to active duty

The hiring freeze implemented by the Presidential Memorandum issued on January 20, 2025, titled Hiring Freeze , or any extension of such Memorandum or freeze, shall not apply to any individual who received a final job offer before January 20, 2025, with respect to a position within the Department of Defense but did not occupy such position solely as a result of such individual performing active service (as that term is defined in section 101 of title 10, United States Code) as a member of the Armed Forces.
This section shall not be construed to confer any right or benefit to any individual, or require the Department of Defense to hire any individual if the applicable position no longer exists, unless otherwise required by law.
