Section 1833(t)(1) of the Social Security Act ( 42 U.S.C. 1395l(t)(1) ) is amended by adding at the end the following new subparagraph: In designating outpatient hospital services pursuant to subparagraph (B)(i), the Secretary may not refuse to so designate such a service based solely on the Secretary’s determination that such service may only be safely furnished in an inpatient setting. .
