Section 10(a)(2) of the Endangered Species Act of 1973 ( 16 U.S.C. 1539(a)(2) ) is amended— in subparagraph (B), by inserting , and shall include the terms and conditions of the related conservation plan, which shall be legally binding on all parties thereto after being complied with ; and by adding at the end the following: Each Federal agency shall, as applicable and to the maximum extent practicable, adopt the mitigation measures contained in a permit issued under subparagraph
(B)in any authorization issued by such Federal agency with respect to the action that is the subject of such permit. With respect to an action that is the subject of a permit issued under subparagraph (B), the Secretary shall not seek any additional mitigation measures through any other Federal or State or local process. . Section 10(a) of the Endangered Species Act of 1973 ( 16 U.S.C. 1539(a) ) is amended by adding at the end the following: A permit issued by the Secretary under this subsection shall be deemed to have been granted an exemption under section 7(h) for the purposes of that section. .
