Subject to valid existing rights, there is established the Dubois Badlands National Conservation Area (referred to in this section as the Conservation Area ), comprising approximately 4,446.46 acres of Federal land administered by the Bureau in the State, as generally depicted on the map entitled Proposed Badlands National Conservation Area and dated November 15, 2023. The purpose of the Conservation Area is to conserve, protect, and enhance for the benefit and enjoyment of present and future generations the ecological, wildlife, recreational, scenic, cultural, historical, and natural resources of the Area.
Subject to valid rights in existence on the date of enactment of this Act, the Secretary shall manage the Conservation Area— in a manner that only allows uses of the Conservation Area that the Secretary determines would further the purpose of the Conservation Area described in subsection (b); and in accordance with— the Federal Land Policy and Management Act of 1976 ( 43 U.S.C. 1701 et seq. ); this section; and any other applicable law. The use of motorized vehicles in the Conservation Area shall be permitted only on existing roads, trails, and areas designated by the Secretary for use by such vehicles as of the date of enactment of this Act.
The Secretary may allow the use of motorized vehicles in the Conservation Area as needed for administrative purposes and emergency response. Grazing of livestock in the Conservation Area shall be administered in accordance with the laws generally applicable to land under the jurisdiction of the Bureau. Subject to valid rights in existence on the date of enactment of this Act, the land within the boundaries of the Conservation Area is withdrawn from— all forms of appropriation or disposal under the public land laws; location, entry, and patent under the mining laws; and disposition under laws relating to mineral and geothermal leasing.
