Section 10405 of the Animal Health Protection Act ( 7 U.S.C. 8304 ) is amended— by redesignating subsection
(d)as subsection (e); and by inserting after subsection
(c)the following: The Secretary, acting through the Administrator of the Animal and Plant Health Inspection Service and the Under Secretary of Agriculture for Trade and Foreign Agricultural Affairs, in coordination with the Administrator of the Food Safety and Inspection Service, may preemptively negotiate, to the extent practicable, regionalization agreements regarding outbreaks of known animal disease threats with the governments of countries with key export markets for any animal, article, or associated means of conveyance from the United States. A negotiation carried out under paragraph
(1)is encouraged to take into account accepted global research advances. . Nothing in this section— limits the ability of the Secretary of Agriculture to negotiate trade agreements; or requires the Secretary of Agriculture to condition other trade agreements on the inclusion of language relating to regionalization as described in subsection (d)(1) of section 10405 of the Animal Health Protection Act ( 7 U.S.C. 3804 ).
