In this Act: The term immigrant means an individual who— is not a citizen or national of the United States; is present in the United States; and is in any status under the immigration laws; or is not in any status under the immigration laws; and intends to resident permanently in the United States. The term immigration laws has the meaning given the term in section 101(a) of the Immigration and Nationality Act ( 8 U.S.C. 1101(a) ). The term refugee has the meaning given the term in section 101(a) of the Immigration and Nationality Act ( 8 U.S.C. 1101(a) ).
