If the Secretary concerned does not require the public to obtain a permit or reservation to access a picnic area on Federal recreational lands and waters administered by the Chief of the Forest Service or Director of the Bureau of Land Management, the Secretary concerned may not require a covered person described in subsection
(b)to obtain a permit solely to access the picnic area. A covered person referred to in subsection
(a)is a person (including an educational group) that provides— outfitting and guiding services on Federal recreational lands and waters; and the services described in paragraph
(1)to fewer than 40 customers annually at the picnic area.
