Sec. 1094. Preferred alternative for the Ambler Mining District in Alaska

In this section, the term Secretary means the Secretary of the Interior. Notwithstanding any other provision of law, not later than 30 days after the date of enactment of this Act, the Secretary shall— select as the preferred alternative for the Ambler Mining District Industrial Access Road Project either Alternative A or Alternative B , as described in the notice of availability of the Bureau of Land Management entitled Notice of Availability of the Ambler Road Final Supplemental Environmental Impact Statement, Alaska and published on April 26, 2024 (89 Fed. Reg. 32458); publish a record of decision that includes the preferred alternative selected under paragraph (1); and in accordance with section 1107 of the Alaska National Interest Lands Conservation Act ( 16 U.S.C. 3167 ), issue all rights-of-way across public lands (as defined in section 102 of that Act ( 16 U.S.C. 3102 )) necessary for the implementation of the preferred alternative selected under paragraph (1).
In carrying out subsection (b), the Secretary, in coordination with the Secretary of Defense, shall select the preferred alternative under paragraph
(1)of that subsection that the Secretary determines— provides adequate and feasible access for economic, defense, and other purposes, including the acquisition and retention of stocks of certain strategic and critical materials; and encourages the conservation and development of sources of certain strategic and critical materials, with respect to any impacts on the national security interests of the United States that sources of those materials may have on the United States, as described in section 2(b) of the Strategic and Critical Materials Stock Piling Act ( 50 U.S.C. 98a(b) ). The Secretary shall carry out subsection
(b)in accordance with subsections
(b)through
(e)of section 201(4) and section 1110(b) of the Alaska National Interest Lands Conservation Act ( 16 U.S.C. 410hh(4) , 3170(b)).
