Sec. 1059. Review, assessment, and analysis of governance structure of counter-narcotics and counter-transnational organized crime activities

Not later than 90 days after the date of the enactment of this Act, the Secretary of Defense shall seek to enter into an agreement with a federally funded research and development center for the conduct of an independent review, assessment, and analysis of the governance structure of the counter-narcotics and counter-transnational organized crime activities of the Department of Defense. The agreement described in subsection
(a)shall provide that not later than one year after the date on which the Secretary of Defense and the federally funded research and development center enter into the agreement, the center shall provide to the Secretary a report on the findings of the review, assessment, and analysis. Upon receipt of the report described in paragraph (1), the Secretary of Defense shall submit the report to the congressional defense committees and the congressional research agencies. The report described in paragraph
(1)shall include the following elements: An assessment of the authorities of the Department of Defense for counter-narcotics and counter-transnational organized crime activities. A description of the context for Department of Defense authorities for counter-narcotics and counter-transnational organized crime activities, including a review of all Federal authorities, by Department and agency, for counter-narcotics and counter-transnational organized crime activities and how those authorities align with the authorities of the Department of Defense. A gap analysis of the authorities described in subparagraphs
(A)and (B). A description of the funding for the counter-narcotics and counter-transnational organized crime activities of the Department of Defense. A description of the strategic objectives and strategies for the counter-narcotics and counter-transnational organized crime activities of the Department of Defense. Recommendations for improving the governance structure of the counter-narcotics and counter-transnational organized crime activities of the Department of Defense, including with respect to designating a lead component or agency within the Department of Defense. The report described in paragraph (1)— shall be submitted under paragraph
(2)in unclassified form, but may include a classified annex; and may be made available to the public. In this section, the term congressional research agencies means the following: The Congressional Research Service. The Congressional Budget Office. The Government Accountability Office.
