Section 595 of the Water Resources Development Act of 1999 (113 Stat. 383; 117 Stat. 1836) is amended— in subsection (a)— by redesignating paragraphs
(1)and
(2)as paragraphs
(2)and (3), respectively; and by inserting before paragraph
(2)(as so redesignated) the following: The term non-Federal interest includes an entity declared to be a political subdivision of the State of New Mexico. ; and in subsection (e)(3)(A)— in the second sentence, by striking The Federal share may and inserting the following: The Federal share may ; by striking the subparagraph designation and heading and all that follows through The Federal share of in the first sentence and inserting the following: Except as provided in clause (ii), the Federal share of ; and by inserting after clause
(i)(as so designated) the following: The non-Federal share of the cost of a project under this section benefitting an economically disadvantaged community (as defined pursuant to section 160 of the Water Resources Development Act of 2020 ( 33 U.S.C. 2201 note; Public Law 116–260 )) shall be 10 percent. .
