Sec. 1341. Missouri River mitigation, Missouri, Kansas, Iowa, and Nebraska

In acquiring any land, or interests in land, to satisfy the total number of acres required for the covered project, the Secretary— may only acquire land, or an interest in land, that— is on the riverward side of levees; or will contribute to future flood risk resiliency projects; may only acquire land, or an interest in land, with the approval of the Governor of the State in which the land is located; and may not acquire land, or an interest in land, by eminent domain. The Secretary shall apply all covered land toward the number of acres required for the covered project in accordance with section 334 of the Water Resources Development Act of 1999 (113 Stat. 306; 136 Stat. 3799).
In this section: The term covered land means any land or interests in land that— is acquired by a Federal agency other than the Corps of Engineers; is located within the meander belt of the lower Missouri River; and the Secretary, in consultation with the head of any Federal agency that has acquired the land or interest in land, determines meets the purposes of the covered project. The term covered project means the project for mitigation of fish and wildlife losses, Missouri River Bank Stabilization and Navigation Project, Missouri, Kansas, Iowa, and Nebraska, authorized by section 601(a) of the Water Resources Development Act of 1986 (100 Stat. 4143; 113 Stat. 306; 121 Stat. 1155; 136 Stat. 2395).
