Section 5169 of the Revised Statutes ( 12 U.S.C. 27 ) is amended— in subsection (a), in the third sentence, by striking to those of a non-depository trust company and activities related thereto. and inserting “to— those of a non-depository trust company and fiduciary activities related thereto; or those of a depository institution for the purposes of issuing a payment stablecoin and activities related thereto as a national payment stablecoin issuer under section 7 of the Lummis-Gillibrand Payment Stablecoin Act . ; and by adding at the end the following: The Comptroller may, by rule, establish assessments depository institutions engaged in issuing payment stablecoins. .
