Notwithstanding any other provision of law, an individual shall be eligible for the benefits described in subsection (b), if the individual— has completed security and law enforcement background checks to the satisfaction of the Secretary of Homeland Security; and has been paroled into the United States under section 212(d)(5) of the Immigration and Nationality Act ( 8 U.S.C. 1182(d)(5) ) pursuant to the implementation of Executive Order 14011, and has not had such parole terminated; or is eligible, based on a determination by the Secretary of Health and Human Services through reference to the identified members of the classes, and their minor children, in the class-action lawsuits J.P. v.
Barr (C.D. Cal. 2020) and Ms. L. v. U.S. Immigration and Customs Enforcement, 330 F.R.D. 284 (2019), for any assistance, program, benefit, or services described in subsection (b). Notwithstanding any other provision of law, an individual described in subsection
(a)shall be eligible for— resettlement assistance, entitlement programs, and other benefits available to refugees admitted under section 207 of the Immigration and Nationality Act ( 8 U.S.C. 1157 ) to the same extent, and for the same periods of time, as such refugees; services described under section 412(d)(2) of the Immigration and Nationality Act ( 8 U.S.C. 1522(d)(2) ), subject to subparagraph
(B)of such section, if such individual is an unaccompanied alien child (as defined in section 462(g) of the Homeland Security Act of 2002 ( 6 U.S.C. 279(g) )); and a driver's license or identification card under section 202 of the REAL ID Act of 2005 (division B of Public Law 109–13 ; 49 U.S.C. 30301 note), notwithstanding subsection (c)(2)(B) of such section.
