In this Act: The term National Forest System has the meaning given the term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 ( 16 U.S.C. 1609(a) ). The term National Forest System does not include— any forest reserve not created from the public domain; or any national grassland or land utilization project administered under title III of the Bankhead-Jones Farm Tenant Act ( 7 U.S.C. 1010 et seq. ). Except as provided in subparagraph (B), the term public lands has the meaning given the term in section 103 of the Federal Land Policy and Management Act of 1976 ( 43 U.S.C. 1702 ).
The term public lands does not include land governed by the Act of August 28, 1937 (50 Stat. 874, chapter 876; 43 U.S.C. 2601 et seq. ). The term Secretary concerned means— the Secretary of Agriculture, acting through the Chief of the Forest Service, with respect to National Forest System land; and the Secretary of the Interior, acting through the Director of the Bureau of Land Management, with respect to public lands.
