If the President determines that doing so will contribute to a just resolution of charges regarding genocide or other violations of international humanitarian law, the President may direct a drawdown pursuant to section 552(c) of the Foreign Assistance Act of 1961 of up to $30,000,000 of commodities and services for the United Nations War Crimes Tribunal established with regard to the former Yugoslavia by the United Nations Security Council or such other tribunals or commissions as the Council may establish or authorize to deal with such violations, without regard to the ceiling limitation contained in paragraph
(2)thereof: That the determination required under this section shall be in lieu of any determinations otherwise required under section 552(c): Provided, That funds made available pursuant to this section shall be made available subject to the regular notification procedures of the Committees on Appropriations. Provided further, Of the funds appropriated by this Act under the heading Diplomatic Programs , not less than $6,000,000 shall be made available for the Office of Global Criminal Justice, Department of State. Of the funds appropriated by this Act under the headings Economic Support Fund and International Narcotics Control and Law Enforcement , not less than $15,000,000 shall be made available for programs to promote accountability for genocide, crimes against humanity, and war crimes, which shall be in addition to any other funds made available by this Act for such purposes: That such programs shall include components to develop local investigative and judicial skills, and to collect and preserve evidence and maintain the chain of custody of evidence, including for use in prosecutions, and may include the establishment of, and assistance for, transitional justice mechanisms: Provided, That such funds shall be administered by the Ambassador-at-Large for the Office of Global Criminal Justice, Department of State, and shall be subject to prior consultation with the Committees on Appropriations: Provided further, That funds made available by this paragraph shall be made available on an open and competitive basis. Provided further, Consistent with the purposes authorized by section 2015 of the American Servicemembers' Protection Act of 2002 ( 22 U.S.C. 7433 ), as amended by section 7073 of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2023 (division K of Public Law 117–328 )— not less than $6,000,000 of the funds made available by this Act under the heading Economic Support Fund shall be made available for support to the International Criminal Court; not less than $5,000,000 of the funds made available by this Act under the heading Economic Support Fund shall be made available as a contribution to the Trust Fund for Victims; and the President shall provide information to the International Criminal Court to assist with investigations and prosecutions of foreign nationals related to the Situation in Ukraine. Of the funds appropriated by this Act under the heading Economic Support Fund , not less than $3,000,000 shall be made available for a contribution to the Special Criminal Court in Central African Republic.
