Section 2112(c) of the Public Health Service Act ( 42 U.S.C. 300aa12(c) ) is amended— in paragraph (1), by striking not more than 8 special masters and inserting not fewer than 10 special masters ; and in paragraph (4)— by striking a term of 4 years and inserting an initial term of 4 years ; by striking the second and third sentences; and by adding at the end the following: An individual appointed as special master may be reappointed to serve one or more additional terms of up to 8 years each, pursuant to paragraph (1), and subject to termination under paragraphs
(2)and (3). . Section 2111(a)(2)(A)(i) of the Public Health Service Act ( 42 U.S.C. 300aa–11(a)(2)(A)(i) ) is amended— in subclause (I), by striking , and and inserting a semicolon; in subclause (II)— by moving the margin 2 ems to the right; and by striking , or and inserting ; and ; and by adding at the end the following: the judgment described in subclause
(I)does not result from a petitioner's motion to dismiss the case; or . Section 2115(e)(1) of the Public Health Service Act ( 42 U.S.C. 300aa–15(e)(1) ) is amended by adding at the end the following: When making a determination of good faith under this paragraph, the special master or court may consider whether the petitioner demonstrated an intention to obtain compensation on such petition and was not merely seeking to satisfy the exhaustion requirement under section 2121(b). .
