Sec. 3. Establishment of commission

There is established the United States Commission on Hate Crimes (in this Act referred to as the Commission ). The Commission shall be composed of 12 members. Members of the Commission shall be appointed in accordance with the following: Two members shall be appointed by the majority leader of the Senate. Two members shall be appointed by the minority leader of the Senate. Two members shall be appointed by the Speaker of the House of Representatives. Two members shall be appointed by the minority leader of the House of Representatives.
Two members shall be appointed by the Attorney General. Two members shall be appointed by the Secretary of Health and Human Services. Not more than 5 members of the Commission may be from the law enforcement community and not more than 5 members of the Commission may be from the civil rights community. Each member of the Commission shall be appointed not later than 60 days after the date of enactment of this Act. The Commission shall hold its first meeting not later than 90 days after the date as of which all members of the Commission have been appointed under subsection (b)(2).
