Section 46301(a) of title 49, United States Code, is amended— in paragraph (1)(A), by inserting section 47107(a)(7) (including any assurance made under such section), section 47107(a)(24) (including any assurance made under such section), after chapter 451, ; and by inserting after paragraph (7), the following: Notwithstanding paragraph (1), the maximum civil penalty for a violation of section 47107(a)(7) (including any assurance made under such section) committed by a person, including if the person is an individual or small business concern, shall be $25,000. In determining the amount of a civil penalty under paragraph
(1)related to a violation of section 47107(a)(7) (including any assurance made under such section), the Secretary of Transportation shall take into account any mitigating circumstances at the airport and facilities on or connected with the airport. Notwithstanding paragraph (1), the maximum civil penalty for a violation of section 47107(a)(24) (including any assurance made under such section) committed by a person, including if the person is an individual or a small business concern, shall be $5,000 for each day that the person is in violation of that section. .
