Title IV of the Women's Business Ownership Act of 1988 ( 15 U.S.C. 7101 et seq. ) is amended— in section 402 ( 15 U.S.C. 7102 )— in subsection (a)— by striking paragraphs
(2)and (5); by redesignating paragraphs
(3)and
(4)as paragraphs
(2)and (3), respectively; and by adding at the end the following: advise Congress and the President on the challenges facing the formation of businesses owned and controlled by women and best practices for facilitating the growth and development of women's business enterprises. ; in subsection (b)— by striking The Interagency and inserting the following: The Interagency ; by striking A majority and inserting the following: A majority ; and by adding at the end the following: Each meetings of the Interagency Committee shall be open to the public. Timely notice of each meeting of the Interagency Committee shall be published in the Federal Register, and the Administrator shall prescribe regulations to provide for other types of public notice to insure that all interested persons are notified of each meeting in advance. Interested persons shall be permitted to attend any meeting of the Interagency Committee and appear before or file statements with the Interagency Committee, subject to such reasonable rules or regulations as the Administrator may prescribe. Subject to section 552 of title 5, United States Code, the records, reports, transcripts, minutes, appendixes, working papers, drafts, studies, agenda, or other documents which were made available to or prepared for or by the Interagency Committee shall be available for public inspection and copying at a single location in the office of the Interagency Committee or the Administration until the Interagency Committee ceases to exist. Detailed minutes of each meeting of the Interagency Committee shall be— kept and shall contain a record of the persons present, a complete and accurate description of matters discussed and conclusions reached, and copies of all reports received, issued, or approved by the Interagency Committee; and certified for accuracy by the chairperson of the Interagency Committee. Subparagraphs
(A)and
(C)shall not apply to any portion of a meeting of the Interagency Committee for which the Administrator determines that such portion of the meeting may be closed to the public in accordance with section 552b(c) of title 5, United States Code. Any determination made under clause
(i)shall— be in writing; and contain the reasons for the determination. If a determination is made under clause (i), the Interagency Committee shall issue a report, not less frequently than annually, setting forth a summary of the activities of the Interagency Committee and such related matters as would be informative to the public consistent with the policy of section 552(b) of title 5, United States Code. There shall be designated an officer or employee of the Federal Government to chair or attend each meeting of the Interagency Committee, who shall be authorized, whenever the officer or employee determines it to be in the public interest, to adjourn any such meeting. The Interagency Committee shall not conduct any meeting in the absence of the designated officer or employee of the Federal Government described in clause (i). ; and by adding at the end the following: The SCORE program described in section 8(c) of the Small Business Act ( 15 U.S.C. 637(c) ), women's business centers described in section 29 of such Act ( 15 U.S.C. 656 ), small business development centers (as defined in section 3 of the Small Business Act ( 15 U.S.C. 632 )), and State and local resource partners of the Administration shall annually submit to the Interagency Committee, the Administration, Congress, and the President findings related to women's business ownership and challenges forming, operating, and growing their business. ; in section 403( 15 U.S.C. 7103 )— in subsection (a)(2)(A), by striking Small Business Administration Reauthorization Act of 1997 and inserting ; and SCORE Act of 2023 in subsection (b)— by striking Not later than 45 days after enactment of the Small Business Administration Reauthorization Act of 1997 and inserting the following: Not later than 45 days after the date of enactment of the SCORE Act of 2023 ; and by adding at the end the following: In the event that a chairperson is not appointed within the time frame required under paragraph (1), the Deputy Administrator of the Administration shall serve as acting chairperson of the Interagency Committee until a chairperson is appointed under paragraph (1). ; and in section 404 ( 15 U.S.C. 1704 ), by striking September 30, 1995 and inserting 1 year after the date of enactment of the . SCORE Act of 2023
