Section 28(d)(2) of the Food and Nutrition Act of 2008 ( 7 U.S.C. 2036a(d)(2) ) is amended— by striking subparagraph
(A)and inserting the following: Of the funds set aside under paragraph (1), as determined by the Secretary, subject to a reallocation under subparagraph (B)— for fiscal year 2024— 40 percent shall be allocated to State agencies in direct proportion to the amount of funding that the State received for carrying out this section during fiscal year 2019; and 60 percent shall be allocated to State agencies based on the respective share of each State of the number of individuals participating in the supplemental nutrition assistance program during the 12-month period ending the preceding January 31; for fiscal year 2025— 30 percent shall be allocated to State agencies in direct proportion to the amount of funding that the State received for carrying out this section during fiscal year 2019; and 70 percent shall be allocated to State agencies based on the respective share of each State of the number of individuals participating in the supplemental nutrition assistance program during the 12-month period ending the preceding January 31; for fiscal year 2026— 20 percent shall be allocated to State agencies in direct proportion to the amount of funding that the State received for carrying out this section during fiscal year 2019; and 80 percent shall be allocated to State agencies based on the respective share of each State of the number of individuals participating in the supplemental nutrition assistance program during the 12-month period ending the preceding January 31; for fiscal year 2027— 10 percent shall be allocated to State agencies in direct proportion to the amount of funding that the State received for carrying out this section during fiscal year 2019; and 90 percent shall be allocated to State agencies based on the respective share of each State of the number of individuals participating in the supplemental nutrition assistance program during the 12-month period ending the preceding January 31; and for fiscal year 2028 and each fiscal year thereafter, 100 percent shall be allocated to State agencies based on the respective share of each State of the number of individuals participating in the supplemental nutrition assistance program during the 12-month period ending the preceding January 31. ; and in subparagraph (B)(ii), by striking 2009 each place it appears and inserting 2019 .
