Section 205 of the Federal Power Act ( 16 U.S.C. 824d ) is amended by striking subsection
(g)and inserting the following: With respect to a change described in subsection (d), if the Commission allows the 60-day period described in that subsection to expire without issuing an order accepting or denying the change because the Commissioners are divided 2 against 2 as to the lawfulness of the change, as a result of vacancy, incapacity, or recusal on the Commission, or because the Commission lacks a quorum— the Secretary of the Commission shall issue a notice stating the reason that the Commission was unable to issue an order accepting or denying the change; the change shall be considered to be rejected; and the rejection described in paragraph
(2)shall take effect automatically, by operation of law, on issuance of the notice described in paragraph (1). .
