Not later than 60 days after the date of enactment of this Act, the Comptroller General of the United States shall begin to conduct an investigation of whether, on or after January 1, 2005, Federal agencies have complied with the Americans with Disabilities Act of 1990 ( 42 U.S.C. 12101 et seq. ), and the Rehabilitation Act of 1973 ( 29 U.S.C. 701 et seq. ), in expending Federal funds to prepare for, respond to, recover from, or mitigate disasters, including whether and, if so, how such funds were used to ensure accessibility to services and supports for individuals with disabilities and older adults.
Not later than 1 year after the date of enactment of this Act, the Comptroller General shall, in accordance with paragraph (2), issue a report on the investigation conducted under subsection (a), along with recommendations for remediation of any misexpenditures identified. Prior to issuing the report under paragraph (1), the Comptroller General shall obtain comments and recommendations on a draft version of the report, including the recommendations described in subparagraph (B), from the National Advisory Committee on Individuals with Disabilities and Disasters established under section 2811C of the Public Health Service Act ( 42 U.S.C. 300hh–10d ) and the Disability and Disaster Preparedness Advisory Committee established under section 9(b) (referred to in this paragraph as the Committees ), and any other agency determined appropriate by the Secretary.
The recommendations obtained under subparagraph
(A)shall include recommendations from the Committees regarding additional sources the Comptroller General may interview for purposes of the investigation under subsection (a).
