A covered entity may not use dark patterns to— divert the attention of an individual from any notice required under this title; impair the ability of an individual to exercise any right under this title; or obtain, infer, or facilitate the consent of an individual for any action that requires the consent of an individual under this title. Any agreement by an individual that is obtained, inferred, or facilitated through dark patterns does not constitute consent for any purpose under this title.
A covered entity may not condition, effectively condition, attempt to condition, or attempt to effectively condition the exercise of a right described in this title through the use of any false, fictitious, fraudulent, or materially misleading statement or representation.
