The Comptroller General of the United States shall conduct an annual audit of the activities of agencies in the legislative and executive branch to determine, with respect to in the year prior to the study— whether data required by law to be provided to the public through the Internet by an agency in the legislative or executive branch of the Federal Government was— made available in accordance with the law, except for data that is subject to privacy, security, or privilege exemptions; collected at the source, with the highest possible level of granularity, not in aggregate or modified forms; made available as quickly as necessary to preserve the value of the data; available to the widest range of users for the widest range of purposes; reasonably structured to allow automated processing; available to anyone, with no registration requirement; available in a format over which no person has exclusive control; and subject to any copyright, patent, trademark, or trade secret protections (with reasonable privacy, security, and privilege restrictions); and determine whether the data provided to the public under this Act is produced and maintained using any standard for data publication required by a law, regulation, executive order, or policy of the Federal Government, including any such standard established by the National Technology Transfer and Advancement Act of 1995 (Public law 104–113), the DATA Act ( Public Law 101–113 ), or OMB Circular A–119.
The Comptroller General shall submit a report on the results of each audit required by subsection
(a)to the Committee on Oversight and Accountability of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate.
