Sec. 711. Temporary requirement for contraception coverage parity under the TRICARE program

The Secretary of Defense shall ensure that, during the one-year period beginning on the date that is 30 days after the date of the enactment of the Act, the imposition or collection of cost-sharing for certain services is prohibited as follows: Notwithstanding subparagraphs (A), (B), and (C), of section 1074g(a)(6) of title 10, United States Code, cost-sharing may not be imposed or collected with respect to any eligible covered beneficiary for any prescription contraceptive on the uniform formulary provided through a retail pharmacy described in section 1074g(a)(2)(E)(ii) of such title or through the national mail-order pharmacy program of the TRICARE Program.
Notwithstanding any provision under section 1075 of title 10, United States Code, cost-sharing may not be imposed or collected for a covered service that is provided by a network provider under the TRICARE program to an eligible covered beneficiary under such section. Notwithstanding subsections (a), (b), and
(c)of section 1075a of title 10, United States Code, cost-sharing may not be imposed or collected for a covered service that is provided under TRICARE Prime to an eligible covered beneficiary under such section. In this section: The term covered service means any method of contraception approved, granted, or cleared by the Food and Drug Administration, any contraceptive care (including with respect to insertion, removal, and follow up), any sterilization procedure, or any patient education or counseling service provided in connection with any such method, care, or procedure. The term eligible covered beneficiary means an eligible covered beneficiary (as such term is used in section 1074g of title 10, United States Code) on the basis of being— a member of the Army, Navy, Marine Corps, Air Force, or Space Force; or a dependent of such a member. The terms TRICARE Program and TRICARE Prime have the meaning given such terms in section 1072 of title 10, United States Code.
