Section 211 of title 37, United States Code, is amended by adding at the end the following: A member of the armed forces may not participate or invest in the Thrift Savings Plan mutual fund window pursuant to section 8438(b)(5) of title 5 if that window includes a mutual fund that holds a Chinese military company (as that term is defined in section 1260H of Public Law 116–283 ) as determined by the mutual fund’s most recent quarterly filing with the Securities and Exchange Commission. . The amendment made by subsection
(a)shall not be construed to limit access of members of the Armed Forces to Thrift Savings Plan mutual funds that do not include any Chinese military company (as defined in section 1260H of Public Law 116–283 ).
