A high impact online company shall exercise reasonable care in the creation and implementation of any design feature to prevent and mitigate the following harms to minors: Consistent with evidence-informed medical information, the following mental health disorders: anxiety, depression, eating disorders, substance use disorders, and suicidal behaviors. Patterns of use that indicate or encourage compulsive usage by minors. Physical violence (as defined in 18 U.S.C. 16 ), cyberbullying and discriminatory harassment of a minor.
Sexual exploitation and abuse of minors. Promotion and marketing of narcotic drugs (as defined in section 102 of the Controlled Substances Act ( 21 U.S.C. 802 )), tobacco products, gambling, or alcohol. Nothing in subsection
(a)shall be construed to require a high impact online company to prevent or preclude— any minor from deliberately and independently searching for, or specifically requesting, content; or the high impact online company or individuals on the platform from providing resources for the prevention or mitigation of the harms described in subsection (a), including evidence-informed information and clinical resources.
