Section 19 of the River and Harbor Act of March 3, 1899 ( 33 U.S.C. 414 ), is amended— by striking by striking and inserting the following: Sec. 19.

(b)The owner and inserting the following: The owner ; and by adding at the end the following: The Secretary of the Army is authorized to remove from the waters of the United States any abandoned vessel or any vessel under the control of the United States by reason of seizure or forfeiture pursuant to any law, that does not obstruct the navigation of such waters, if— such removal is determined to be in the public interest by the Federal Government, a State, or an Indian tribe; and in the case of a vessel that is not under the control of the United States by reason of seizure or forfeiture, the Commandant of the Coast Guard makes a determination that the vessel is abandoned in accordance with section 4711 of title 46, United States Code. In removing a vessel under this section that is under the control of the United States by reason of seizure or forfeiture, the Secretary shall enter into an interagency agreement with the head of the Federal department, agency, or instrumentality that has control of such vessel. The owner of any vessel described in paragraph
(1)that is not under the control of the United States by reason of seizure or forfeiture shall be liable to the United States for the costs of removal and disposal of such vessel. . Section 1115 of the Water Resources Development Act of 1986 (100 Stat. 4235; 102 Stat. 4026) is repealed.
