Section 167 of the Workforce Innovation and Opportunity Act ( 29 U.S.C. 3222 ) is amended— in subsection (c), by adding at the end the following: The Secretary shall make arrangements with a State or other appropriate entity to facilitate the use of State wage records to evaluate the performance of entities funded under this section on the employment and earnings indicators described in subclauses
(I)through
(III)of section 116(b)(2)(A)(i) for the purposes of the report required under paragraph (4). For each program year, the Secretary shall make available on a publicly accessible website of the Department a report on the performance, during such program year, of entities funded under this section on— the primary indicators of performance described in section 116(b)(2)(A); and the adjusted levels of performance for such entities as described in paragraph (3). ; by redesignating subsections (e), (f), (g), (h), and
(i)as subsections (f), (g), (h), (i), and (j), respectively; by inserting after subsection
(d)the following: Not more than 10 percent of the funds provided to an entity under this section may be used for the administrative costs of the activities and services carried out under subsection (d). ; and in subsection (i), as so redesignated, to read as follows: From the funds appropriated and made available to carry out this section, the Secretary shall reserve not more than 1 percent for discretionary purposes, such as providing technical assistance to eligible entities. Funds appropriated and made available to carry out this section for any fiscal year may be obligated by the Secretary during the period beginning on April 1 of the calendar year that begins during such fiscal year and ending on June 30 of the following calendar year to be made available to an entity described in subsection
(b)for the period described in subparagraph (B). Funds made available under this section for a fiscal year to any entity described in subsection
(b)may be spent or reserved for spending by such entity during the period beginning on July 1 of the calendar year that begins during such fiscal year, and ending on June 30 of the following calendar year. .
