Section 152 of the Workforce Innovation and Opportunity Act ( 29 U.S.C. 3202 ) is amended— by striking centers each place it appears and inserting campuses ; in subsection (a), by inserting As part of the operating plan required under section 151(a), the director of each Job Corps campus shall develop and implement a behavior management plan consistent with the standards of conduct and subject to the approval of the Secretary. at the end; and in subsection (b)(2)(A), by striking or disruptive ; by amending subsection
(c)to read as follows: A disciplinary measure taken by a director under this section shall be subject to expeditious appeal in accordance with procedures established by the Secretary. The Secretary shall establish an appeals process under which the director of a Job Corps campus may submit a request that an enrollee who has engaged in an activity which is a violation of the guidelines established pursuant to subsection (b)(2)(A) remain enrolled in the program, but be subject to other disciplinary actions. An request under paragraph
(A)shall include— a signed certification from the director attesting that, to the belief of the director, the continued enrollment of such enrollee would not impact the safety or learning environment of the campus; and the behavioral records of such enrollee. The Secretary shall review such appeal and either approve or deny the appeal within 30 days of receiving such appeal. The Secretary shall reject an appeal made by a director of a Job Corps campus if such campus has been found out of compliance with the requirements under subsection
(d)at any time during the previous 5 years. ; and by adding at the end the following: The Secretary shall require that the director of a Job Corps campus report to the appropriate regional office— not later than 2 hours after the campus management becomes aware of the occurrence of— an enrollee or on-duty staff death; any incident— requiring law enforcement involvement; involving a missing minor student; or where substantial property damage has occurred; or a level 1 infraction; in the case of a level 2 infraction, on a quarterly basis, including the number and type of such infractions that occurred during such time period; and in the case of a minor infraction, as determined necessary by the Secretary. In this subsection: The term level 1 infraction means an activity described in subsection (b)(2)(A). The term level 2 infraction means an activity, other than a level 1 infraction, determined by the Secretary to be a serious infraction. The term minor infraction means an activity, other than a level 1 or 2 infraction, determined by the Secretary to be an infraction. The director of each Job Corps campus shall enter into an agreement with the local law enforcement agency with jurisdiction regarding procedures for the prompt reporting and investigation of potentially illegal activity on Job Corps campuses. .
