Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall review and, if determined that such action will achieve an equivalent level of safety, shall amend the safety standards in part 195 of title 49, Code of Federal Regulations, relating to the internal inspection of the bottoms of in-service breakout tanks to allow for risk-based inspections. If the Secretary amends the safety standards described in subsection (a), the Secretary shall consider the 5th edition of standard 653 published by the American Petroleum Institute issued November 2014 titled Tank Inspection, Repair, Alteration, and Reconstruction .
If the Secretary amends the safety standards described in subsection (a), the Secretary shall ensure that such risk-based inspection standards achieve a level of safety that is equivalent to the level of safety required under such part 195, as in effect on the date of enactment of this Act.
