Section 445 of the General Education Provisions Act ( 20 U.S.C. 1232h ) is amended— in subsection (a)— by striking All instructional materials and inserting
(1)All instructional materials ; and by adding at the end the following: All medical or counseling records pertaining to a student shall be available for inspection by a parent of such student, upon request, unless the inspection of such record by the parent is prohibited by a protection order (as defined in section 2266 of title 18, United States Code). ; and in subsection (c)(6)— by redesignating subparagraphs
(D)through
(G)as subparagraphs
(E)through (H), respectively; and by inserting after subparagraph
(C)the following: The term medical or counseling record means a record that— is in the possession of a local educational agency; and relates to medical care or academic or mental health counseling provided to a student. .
