None of the funds made available by this Act may be used to conduct an interview in connection with an investigation of a Federal offense, or an investigation in which the agency is assisting a State, local or Tribal law enforcement agency, unless such interview is recorded using electronic audio recording equipment. Subsection
(a)shall apply with respect to custodial and noncustodial interviews, but shall not apply with respect to— communications with confidential informants; or interviews of non-United States persons conducted outside the United States. Recordings of such interviews shall be retained for 10 years.
