Section 3(l)(5) of the Federal Deposit Insurance Act ( 12 U.S.C. 1813(l)(5) ) is amended— in subparagraph (B), by striking ; and and inserting a semicolon; in subparagraph (C), by striking the period at the end and inserting ; and ; and by adding at the end the following: any— digital asset (as defined in section 1a of the Commodity Exchange Act ( 7 U.S.C. 1a )); or digital asset security (as defined in section 3(a) of the Securities Exchange Act of 1934 ( 15 U.S.C. 78c(a) ). .
Section 101(5) of the Federal Credit Union Act ( 12 U.S.C. 1752(5) ) is amended by striking State law and inserting State law: . Provided further : That in no case may such terms include a digital asset (as defined in section 1a of the Commodity Exchange Act ( 7 U.S.C. 1a )) or digital asset security (as defined in section 3(a) of the Securities Exchange Act of 1934 ( 15 U.S.C. 78c(a) )
