Any person that is registered with the Securities and Exchange Commission as a digital asset broker, digital asset dealer, or digital asset trading system may register with the Commodity Futures Trading Commission, as appropriate, as— a digital commodity exchange under section 5i of the Commodity Exchange Act ( 7 U.S.C. 1 et seq. ), as added by this Act, if the person offers or seeks to offer a cash or spot market in at least one digital commodity; a digital commodity broker under section 4u of the Commodity Exchange Act, as added by this Act, if the person is engaged in soliciting or accepting orders in digital commodity cash or spot markets; or a digital commodity dealer under section 4u of the Commodity Exchange Act, as added by this Act, if the person holds themself out as a dealer in digital commodity cash or spot markets.
