Of the unobligated amounts available under the heading Department of Energy—Energy Programs—Nuclear Energy in division J of the Infrastructure Investment and Jobs Act ( Public Law 117–58 ) for fiscal years 2024, 2025, and 2026, the following are available, in addition to amounts otherwise made available for these purposes: $2,400,000,000 for Advanced Nuclear Fuel Availability, of which $800,000,000, to remain available until expended, shall be available in each of fiscal years 2024, 2025, 2026. Funds available under subparagraph
(A)shall only be available if a law is enacted after May 1, 2023, that specifically authorizes a program for the Secretary of Energy to support the availability of low-enriched uranium, including high-assay low-enriched uranium, for civilian domestic research, development, demonstration, and commercial use. $1,197,000,000 to carry out the ongoing demonstration project under the Advanced Small Modular Reactor RD&D program, of which $399,000,000, to remain available until expended, shall be available in each of fiscal years 2024, 2025, and 2026. Amounts repurposed pursuant to this paragraph that were previously designated by the Congress as an emergency requirement pursuant to the Balanced Budget and Emergency Deficit Control Act of 1985 or a concurrent resolution on the budget are designated by the Congress as an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.
