Sec. 251. Flight instructor certificates

Not later than 36 months after the date of enactment of this Act, the Administrator of the Federal Aviation Administration shall issue a final rule for the rulemaking activity titled Removal of the Expiration Date on a Flight Instructor Certificate , published in Fall 2022 in the Unified Agenda of Federal Regulatory and Deregulatory Actions (RIN 2120–AL25) to, at a minimum, update part 61 of title 14, Code of Federal Regulations, to— remove the expiration date on a flight instructor certificate; and replace the requirement that a flight instructor renews their flight instructor certificate with appropriate recent experience requirements for the holder of a flight instructor certificate to exercise the privileges of such certificate.
If the Administrator fails to issue a final rule pursuant to subsection
(a)before the deadline prescribed in that subsection, beginning on the date that is 36 months after the date of enactment of this Act— notwithstanding sections 61.19(d) and 61.197 of title 14, Code of Federal Regulations, an individual holding a flight instructor certificate that is not expired as of the date that is 36 months after the date of enactment of this Act may exercise the privileges of the certificate regardless of whether the certificate subsequently expires, provided that the individual meets eligibility requirements in accordance with section 61.183 of title 14, Code of Federal Regulations; and the Administrator— shall consider a flight instructor certificate described in paragraph
(1)as having no expiration date; and may not enforce any regulation attributed to the renewal of a flight instructor certificate of an individual. Subsection
(b)shall cease to be effective on the effective date of a final rule issued pursuant to subsection (a).
