Nothing in this section may be construed to— affect any airport sponsor under an investigation initiated by the Administrator under part 13 or 16 of title 14, Code of Federal Regulations, relating to the availability of aviation gasoline found to be out of compliance with the grant assurance described in subsection
(b)before the date of enactment of this Act; require any particular action by the Administrator if the Administrator determines through such investigation that such airport sponsor has violated a grant assurance; or prevent an airport or any retail fuel seller at such airport from making available for purchase and resale an unleaded aviation gasoline that has been approved by the Federal Aviation Administration and has an industry consensus standard for use in lieu of leaded aviation gasoline if such unleaded aviation gasoline is certified for use in all aircraft spark ignition piston engine models.
