Section 106(r) of title 49, United States Code, is amended— in paragraph (1)— by striking subparagraph
(A)and inserting the following: There shall be a Chief Operating Officer for the air traffic control system who is appointed by the Administrator and subject to the authority of the Administrator. ; and in subparagraph
(E)by striking shall be appointed for the remainder of that term and inserting may be appointed for either the remainder of the term or for a full term ; in paragraph
(2)by striking , with the approval of the Air Traffic Services Committee ; in paragraph (3)— by striking , in consultation with the Air Traffic Services Committee, ; and by striking annual basis. and inserting— annual basis and shall include responsibility for— the state of good repair of the air traffic control system; the continuous improvement of the safety and efficiency of the air traffic control system; and identifying services and solutions to increase the safety and efficiency of airspace use and to support the safe integration of all airspace users. ; in paragraph
(4)by striking such information as may be prescribed by the Secretary and inserting the annual performance agreement required under paragraph (3), an assessment of the performance of the Chief Operating Officer in relation to the performance goals in the performance agreement for the previous year, and such other information as may be prescribed by the Administrator ; and in paragraph (5)— by striking Chief Operating Officer, or any other authority within the Administration responsibilities, including and inserting Chief Operating Officer any authority of the Administrator and shall delegate, at a minimum ; in subparagraph (A)— in clause
(iii)by striking and at the end; in clause
(iv)by striking the period at the end and inserting ; and ; and by adding at the end the following: plans to integrate new entrant operations into the national airspace system and associated action items. ; and in subparagraph (C)(ii) by striking and the Committee .
