Section 407(b)(3) of the Social Security Act ( 42 U.S.C. 607(b)(3) ) is amended by adding at the end the following: The Secretary shall determine the minimum participation rate of a State for a fiscal year under this subsection without regard to cases that are funded by an amount expended in excess of the applicable percentage of the historic expenditures (as defined in section 409(a)(7)(B)(ii)) of the State for the fiscal year. .
