Subsection
(c)of section 1260H of the William M.
(Mac)Thornberry National Defense Authorization Act for Fiscal Year 2021 ( 10 U.S.C. 113 note) is amended by adding at the end the following sentence: The Secretary of Defense shall also consider information related to a Chinese military company operating directly or indirectly in the United States or any of its territories and possessions that is provided jointly by the chair and ranking member of any of the congressional defense committees in making such determinations. . Subsection (b)(1) of such section 1260H is amended— by striking the period at the end and inserting a semicolon; by striking as applicable, an explanation and inserting the following: as applicable— an explanation ; and by adding at the end the following: an identification of each entity included in the list pursuant to information provided by the chair and ranking member of a congressional defense committee and considered in accordance with subsection (c); and with respect to each entity considered for inclusion in the list pursuant to such information, and with respect to which the Secretary of Defense determined that the entity did not meet the criteria for inclusion, a justification for such determination. .
