Section 4951(1) of title 10, United States Code, is amended— in subparagraph (C), by striking private ; by redesignating subparagraph
(D)as subparagraph (E); and by inserting after subparagraph
(C)the following new subparagraph: An institution of higher education, as defined in section 101 of the Higher Education Act of 1965 ( 20 U.S.C. 1001 ). . Section 4951 of title 10, United States Code, is amended by adding at the end the following new paragraph: The term business entity means a corporation, association, partnership, limited liability company, limited liability partnership, consortia, nonprofit organization, or other legal entity. . Section 4954(c) of title 10, United States Code, is amended to read as follows: The Secretary may waive or modify the percentages in subsection
(b)on a case-by-case basis. . Section 4955 of title 10, United States Code, is amended by adding at the end the following new subsection: The Secretary of Defense may only use amounts appropriated under this chapter for the execution and administration of this chapter. .
