Sec. 3513. Port infrastructure development program: eligibility of shore power projects; selection criteria

In making port infrastructure development grants under section 54301 of title 46, United States Code, for fiscal year 2024, the Secretary of Transportation shall treat a project described in paragraph
(2)as— having met the requirements of paragraphs
(1)and (6)(A)(i) of section 54301(a) of such title; and being an eligible project under section 54301(a)(3) of such title. A project described in this paragraph is a project to provide shore power at a port that services both of the following: Passenger vessels described in section 3507(k) of title 46, United States Code. Vessels that move goods or freight. Section 54301(a)(6) of title 46, United States Code, is amended— in subparagraph (A)(ii), by inserting (except in the case of a project described under subparagraph (C)) after effective ; in subparagraph (B)(ii), by inserting (except in the case of a project described under subparagraph (C)) after as applicable ; and by adding at the end, the following: The requirements under subparagraphs (A)(ii) and (B)(ii) shall not apply in the case of a project described in paragraph
(3)in a noncontiguous State or territory. .
