Subsection
(a)of section 1236 of the Carl Levin and Howard P. Buck McKeon National Defense Authorization Act for Fiscal Year 2015 ( Public Law 113–291 ; 128 Stat. 3559) is amended, in the matter preceding paragraph (1)— by striking $4,000,000 and inserting $6,000,000 ; and by striking December 31, 2023 and inserting December 31, 2024 . Subsection
(g)of such section is amended by striking Overseas Contingency Operations for fiscal year 2023, there are authorized to be appropriated $358,000,000 and inserting fiscal year 2024, there is authorized to be appropriated $241,950,000 . Subsection
(o)of such section is amended— in paragraph (1)— by striking
(1)and inserting In general .—The President
(1); and Authority of President .—The President by striking paragraph
(2)and inserting paragraph
(3); by redesignating paragraphs (2), (3), (4), and
(5)as paragraphs (3), (4), (5), and (6), respectively; by inserting after paragraph
(1)(as so amended) the following: The Secretary of Defense may further adjust the total cost of a project subsequent to a waiver by the President of the dollar amount limitation in subsection
(a)if— such total cost does not exceed the sum of— the cost estimate for the project as required by paragraph (4)(B)(i) that is included in the notification submitted by the President pursuant to such waiver; and the amount that is 50 percent of such cost estimate; and the Secretary submits to the appropriate congressional committees a notification of the exercise of the adjustment. The Secretary may modify the scope of a project subsequent to a waiver by the President of the dollar amount limitation in subsection
(a)if the Secretary submits to the appropriate congressional committees a notification of the exercise of the modification. ; in paragraph
(4)(as so redesignated)— in subparagraph (A), by adding at the end the following: A project with respect to which the exercise of a further adjustment to the total cost of the project under paragraph (2)(A) applies or with respect to which the exercise of a modification to the scope of the project under paragraph (2)(B) applies may only be carried out after the end of a 15-day period beginning on the date on which the appropriate congressional committees receive the notification required by paragraph (2)(A) or (2)(B), as the case may be. ; and in subparagraph (B), in the matter preceding clause (i), by inserting , (2)(A), or (2)(B) after (1)(B) ; and in paragraph
(6)(as so redesignated)— by striking waiver authority and inserting waiver and other authorities ; and by striking December 31, 2023 and inserting December 31, 2024 .
