Section 408 of title 10, United States Code, is amended— in the section heading, by striking and inserting Equipment and training of foreign personnel to assist in ; Assistance in support of in subsection (b), by adding at the end the following new paragraph: Funds. ; in subsection (d)— in the subsection heading, by striking and inserting Limitation ; Limitations by striking The and inserting
(1)Except as provided in paragraph (2), the ; by striking $1,000,000 and inserting $5,000,000 ; and by adding at the end the following new paragraphs: The Secretary may waive the limitation under paragraph
(1)if the Secretary submits to the congressional defense committees notice of the waiver together with the reasons why the waiver is necessary. No assistance may be provided under this section to a foreign nation the government of which the Secretary of State determines has repeatedly provided support for international terrorism pursuant to— section 1754(c)(1)(A) of the Export Control Reform Act of 2018 ( 50 U.S.C. 4813(c)(1)(A) ); section 620A of the Foreign Assistance Act of 1961 ( 22 U.S.C. 2371 ); or section 40 of the Arms Export Control Act ( 22 U.S.C. 2780 ). ; by striking subsection (f); and by adding at the end the following new subsection (f): Not later than December 31 of each year, the Secretary of Defense shall submit to the congressional defense committees a report on the assistance provided under this section during the preceding fiscal year. . Not later than July 1, 2024, the Secretary of Defense shall provide to the Committees on Armed Services of the Senate and House of Representatives a briefing on the provision of funds under section 408 of title 10, United States Code, as amended by subsection (a), and the anticipated demand for such funds.
