Section 4872(c) of title 10, United States Code, is amended— in the matter preceding paragraph (1), by striking Subsection
(a)and inserting Subsection (a)(1) ; and in paragraph (1)— by striking Defense determines that covered materials and inserting the following: Defense— identifies a specific end item for which a specific covered material ; by striking the period at the end and inserting a semicolon; and by adding at the end the following new subparagraphs: determines that no production capacity for such specific covered material exists and is available outside of the covered nations; and waives subsection (a)(1) for such specific end item and such specific covered material for a period not exceeding 36 months. .
